Exploring an Appropriate Legal Mechanism for Consumers in Halal Food Abuse Cases

Abstract

This preliminary study aims to explore a legal mechanism dedicated to addressing issues related to consumer rights and protection in cases of Halal food abuse. Halal food, which adheres to Islamic dietary laws and guidelines, holds a significant importance for Muslim consumers worldwide. Ensuring the authenticity and integrity of Halal food is essential, given the growing global demand for these items. This study employed a multidisciplinary approach, drawing data from Islamic jurisprudence, consumer protection laws, and existing models concerning dispute resolution mechanisms. It explored contemporary challenges faced by consumers in verifying the Halal status of food products and seeking redress in cases of fraud, mislabelling, or contamination through an extensive review of literature, legal frameworks, and case studies. Effective law enforcement is essential in efforts to guarantee that halal food producers fulfill their legal requirements and, more crucial, increase Muslim customers’ trust in halal food products. Therefore, the objective of this study is to propose a consumer protection mechanism for addressing Halal abuse in Malaysia. This qualitative study obtained information and data from interviews and document analyses involving statutes, articles, and journals. Findings indicated a lacuna in the consumer remedy and an avenue for claims in Halal food abuse cases. It is suggested that the current legislation pertaining to consumer rights should be consolidated and an avenue proposed for consumers to vindicate their rights and receive protection against Halal food abuse cases.
